“Seller/we/our/us/ElishaHair” refers to ElishaHair (registered in England, company registration no. ——————), and the company’s website www.elishahair.co.uk.
“Customer” denotes the individual or company to whom this document is addressed.
“International Customer” signifies a “Customer” located outside the United Kingdom.
“Website” corresponds to www.elishahair.co.uk or any subdomains of elishahair.co.uk that may be accessible, unless expressly excluded by their own terms and conditions.
“Online Store” signifies the platform through which the Customer can browse and purchase products from ElishaHair, which is the Website.
“Order” designates the submission of an order for products through the “Online Store” by the “Customer.”
1.1 These terms and conditions apply to the provision of products by the Seller, hereafter referred to as ElishaHair, to the buyer, hereafter referred to as the Customer.
1.2 The Online Store is intended for use by individuals aged 15 and over. If you are under this age, please refrain from using the Online Store.
2.1 The prices of the goods will be as quoted on the Online Store from time to time. We take reasonable care to ensure that the prices of goods are accurate when entered into the system. However, if we discover an error in the price of Product(s) you ordered, please see clause 2.4 for the resolution process.
2.2 Prices for our goods may change periodically, but such changes will not affect confirmed orders.
2.3 All prices are quoted in GB Pound Sterling and include VAT (where applicable) at the prevailing rate in the UK. If the VAT rate changes between your order date and the delivery date, we will adjust the VAT accordingly unless you have already paid in full before the change takes effect.
2.4 The Online Store offers a wide range of products, and despite our best efforts, some products may be incorrectly priced. In such cases, we will inform you of the error and provide the option to purchase the product at the correct price or cancel your order. We will not process your order until we have your instructions. If we cannot contact you using the provided contact details, we will consider the order canceled and notify you in writing. Please note that if the pricing error is obvious and could have reasonably been recognized by you as a mispricing, we are not obligated to provide the products at the incorrect (lower) price.

3.3 Discount or promotional codes issued by ElishaHair from time to time are subject to specific terms and conditions, including eligibility, maximum order value, and potential exclusions of certain brands or products. Refer to the Promotion Exclusions page on the Online Store for details. In case of any contradictions between these terms and the discount code terms, the discount code terms prevail.
3.4 We reserve the right to reject or cancel orders that do not comply with these terms, even if your credit or debit card has been charged. In such cases, we will refund the full amount paid for the order.
4.1 ElishaHair will retain ownership of the goods until full payment has been received from the Customer. Ownership of the goods will transfer to the Customer upon full payment.
5.1 All Orders are subject to acceptance and availability. Upon placing an Order with ElishaHair, the Customer will receive an order acknowledgment and subsequent update email(s). Receiving these acknowledgments and emails does not confirm the acceptance of the Order by ElishaHair.
Order acceptance and the formation of a contract between ElishaHair and the Customer will commence when the products ordered are dispatched from ElishaHair’s warehouse to the address provided by the Customer.
5.2 ElishaHair will make reasonable efforts, in accordance with applicable laws, to secure the Customer’s Order and payment details. However, ElishaHair cannot be held liable for any loss resulting from unauthorized access to your data if no negligence on our part is identified (subject to applicable data protection and privacy laws). Please note that internet transmissions are not entirely secure, and while we strive to protect your personal data, we cannot guarantee the security of data transmitted to the Online Store. Once received, we will implement strict security measures to prevent unauthorized access.
6.1 The indicated delivery dates or periods are for reference only. Our standard policy is to endeavor to dispatch all orders within 3 working days. Products not available at the time of your order will be sent to you as soon as they are received from the supplier. In any event, delivery will occur within 30 days after we accept your order.
If delivery delays occur due to the supplier, the carrier, or any other third party, Elishahair will promptly inform you. If this is done, we shall not be held liable for such delays. In the event of substantial delays, you have the option to terminate the contract, as outlined in clause 10 below, and receive a refund for any products paid for but not yet received.
6.2 We deliver to countries listed on the Online Store, subject to our discretion (“International Delivery Destinations”). However, some goods are restricted for specific International Delivery Destinations. Please review the Online Store information carefully before ordering goods.
6.3 When ordering goods for delivery to International Delivery Destinations, your order may be subject to import duties and taxes applied upon arrival. Please be aware that we have no control over these charges and cannot predict their amount.
6.4 You are responsible for paying any import duties and taxes. Prior to placing your order, please contact your local customs office for further information.
6.5 You must adhere to all applicable laws and regulations of the destination country for the products. We shall not be liable if you violate any such law.
6.6 If Elishahair delivers your products late, you may consider the order terminated under any of the following conditions: Elishahair refused to deliver the goods, delivery within the stipulated timeframe was crucial (considering all relevant circumstances), or you notified Elishahair before the order acceptance that timely delivery was essential. If you choose not to terminate the order, you can set a new reasonable delivery deadline and cancel the order if Elishahair fails to meet the new deadline. Alternatively, you can cancel the order and receive refunds for the products and delivery.
For delivered products, you must return them to Elishahair at the address provided, and we will refund the return costs.
7.1 All orders will be delivered using the service specified at the time of ordering. Additional delivery method details can be found at https://elishahair.co.uk/deliveries-returns-and-collection/. Elishahair reserves the right to adjust prices in proportion to shipping costs, but you will always be informed of the delivery cost before completing your order. Customers must specify any alternative delivery method at the time of ordering.
8.1 Once the products ordered are delivered to the address specified in the order, you assume responsibility for them. Elishahair accepts no liability for undelivered parcels due to incorrect or invalid delivery addresses provided by the Customer or failure to collect the order from the specified delivery address, despite our reasonable attempts to contact you.
8.2 If a third party, authorized by you to accept the products or a courier commissioned by you to deliver the products, loses an order, Elishahair bears no risk once the products have been delivered to them. For damaged goods received, a full refund will be issued if we are notified of the issue within 14 days of delivery through phone, email, or written communication. You will then be required to return the goods, along with their original packaging, to Elishahair’s trading address, as per clauses 9 and 10 below.
8.3 If goods are signed for, you assume the risk once the goods are signed for (provided they are signed for by you or an authorized person). If you suspect tampering with a parcel, you should refuse to sign for the goods (for clarity, signing for the parcel does not affect your return rights under clause 10).
9.1 Once we have received full payment for the products, you become the owner of the products. You should inspect the goods reasonably after receiving them. According to the Consumer Rights Act 2015, products must be as described, fit for purpose, and of satisfactory quality. If the goods are found faulty or misdescribed, you are entitled to a full refund, product repair or replacement, or partial refund (as outlined in clause 10 below) and must notify us accordingly.
10.1 Should the Customer wish to reject the goods, they must adhere to the return procedure outlined in this clause 10. ElishaHair will only accept returned goods if the return process is followed as described above.
10.2 The Customer is required to follow the returns policy as detailed on our website at https://elishahair.co.uk/deliveries-returns-and-collection/. This entails notifying ElishaHair of the intent to return any goods via email.
10.3 If the rejection of goods is due to a defect or an order discrepancy, the Customer is entitled to a full refund within 14 days of product delivery. The Customer must inform ElishaHair within 14 days of delivery and return the product to ElishaHair before the refund can be processed.
We will assess the returned product and issue a refund within a reasonable timeframe, not exceeding 7 days from the date of confirming the entitlement to a refund for the defective product. Products returned due to defects will be refunded in full, including the delivery charges for sending the item to you and the costs incurred by you in returning the item to us.
10.4 In cases where product rejection is due to a defect or misdescription, in addition to the right outlined in clause 10.3 above, for up to 30 days following the product delivery date, the Customer may be entitled to a refund (at our discretion). The Customer must adhere to our returns policy and return the product to us.
10.5 If the rejection is due to an incorrect order by the Customer or dissatisfaction (where we are not at fault), the Customer is entitled to a partial refund (full refund of the goods less any postage costs), unless the order is canceled within the cooling-off period according to clause 11, in which case a full refund will be provided. However, the Customer is responsible for the cost of returning the item to ElishaHair. Goods must be returned to ElishaHair before the partial refund can be issued.
10.6 If you wish to cancel the order due to something we have done or are going to do, please notify us following our returns procedure, and we will provide a full refund for any products not delivered (including delivery costs). You may also be entitled to compensation, including the following:
10.8 When returning a product, the Customer must either do so in person, mail it to ElishaHair, or, if it is not suitable for postal return, allow us to collect it from you. If you are returning products in accordance with clauses 6.6, 10.3, 10.4, or 10.7, we will cover the postage or collection costs.
11.1 Cancellations not related to a defect or discrepancy are accepted only if the Customer follows the cancellation procedure below and subsequently adheres to the Returns Procedure outlined in Clause 10.
11.2 Within 14 days of receiving the goods, the Customer must contact ElishaHair in writing via the provided contact details. Following this notification, the goods must be returned to us within 14 days of informing us of your decision to change your mind. The goods must be in ‘as new’ and unused condition, in their original undamaged packaging with unbroken seals, including all items and free gifts received. The Customer is responsible for taking reasonable care of the products until they are returned to ElishaHair. If the goods have been used in a manner exceeding what a customer would typically do in a retail shop prior to purchase, and this usage results in a reduction in value, the Customer agrees that ElishaHair is entitled to deduct an amount reflecting such reduction. Any refund will be issued within 14 days of receiving the Customer’s returned products.
12.1 If we fail to comply with these Terms, we are liable for the loss or damage you incur as a foreseeable consequence of our breach of these Terms or our negligence. However, we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious outcome of our breach or if it was considered by you and us when we entered into the contract.

12.4 As a consumer, you have legal rights concerning faulty or misrepresented products. Guidance on your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. These legal rights remain unaffected by these Terms.

14.1 The Customer must respect all license agreements provided by copyright owners. ElishaHair cannot be held responsible or liable for any misuse by the Customer or any third party.
14.2 All trademarks displayed on www.elishahair.co.uk belong to their respective owners and may not be copied without prior permission.
14.3 You may not use any part of the materials on the Online Store for commercial purposes without obtaining a license from us or our licensors.
15.1 When you submit a review or use another feature allowing you to upload content to the Online Store or contact other users, you warrant that your submission is accurate and that it does not contain unlawful or objectionable content. This includes, but is not limited to, content that is abusive, threatening, harassing, defamatory, ageist, sexist, or racist. You also warrant that your contribution complies with these standards and that you own or control all rights to the content you post, and that it does not breach or infringe the rights of any third party. You indemnify us for any breach of these warranties.
15.2 Any material you upload to the Online Store will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute, and disclose such material to third parties for any purpose. You waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.
15.3 We have the right to use the name you submit in connection with such content and to disclose your identity to any third party claiming that any material posted or uploaded by you to the Online Store violates their intellectual property rights or their right to privacy.
15.4 We are not responsible or liable for the content or accuracy of materials posted by you or any other user of the Online Store.
15.5 We have the right to remove any material or posting you make on the Online Store if, in our opinion, it does not comply with the content standards set out above.
16.1 Customers from outside the UK can only pay with an International credit card and must pay in GB Pound Sterling, unless otherwise specified. Although the Online Store may display the Product value in your local currency, the exchange rate at the date of purchase shall apply, ensuring payment is received by ElishaHair in GB Pound Sterling. All other terms and conditions apply.
17.1 We reserve the right to amend these terms and conditions at any time but will provide advance notice of such changes.
18.1 These terms and conditions are governed by and shall be interpreted in accordance with English Law, subject to the non-exclusive jurisdiction of the courts of England and Wales. Any person attempting fraudulent credit card transactions will be prosecuted without exception.
